Another Situation Advise needed please.

Post by banku » Sun May 19, 2013 9:26 pm

Hi there,
First of all I would thank and congratulat the admins of this great website ,When even I need any advice I know this is the website to get that. And I also keep visiting the questions incase I might have been through the same situation so that I can answer that.
Now I have a question
Me and my Mrs. came over to Canada I am the primary applicant and I came over under the Pilot Program for Long Haul Truck drivers in Alberta. We chose this category so that we could get the PR in Canada a bit quickly so that we can start our life in a better way. But the company I am working for has a bad impression in regards of immigration , cause many of the people who applied for their AINP in December 2012 have not heard anything back from the immigration office yet. And some one told me that any of this company’s previous employee has reported this company for charging/asking money for immigration and bla bla and they had a raid from the immigration officers in this company’s office.
I am really concerned about all this ,it has been about 6-7 months since I started working in Alberta as a Long Haul Truck driver and this job is really hard to co-op with especially for a person who has a family. My wife is working for a good employer in Alberta and her employer is willing to help us out so that my Mrs. can get her work permit from her present employer and I can get an open work permit and work for any local company or do any local job so that I could be home daily.
Can you please guide us if that is possible? Her job is related to the Leather Furs clothing . we are not sure if it comes under skilled or semi-skilled workers or not.
Also can you please shed some light on What the employer will have to do if this all could work out?
Many Thanks.

All provincial nominations for Long Haul Drivers, take at least 4 months to be processed.

In terms of your wife's employment, I wouldn't know if it might considered skilled. But it's a positive note that her employer is willing to sponsor her PR. This is the procedure to sponsor her:

1) Employer advertises position for at least 14 days.
2) If no suitable applicants are found, then they apply for an LMO
3) Once approved, your wife can either flagpole (leave Canada, go to the USA and re-enter Canada immediately) or can apply for a work permit within Canada (this is actually taking almost 72 days)
4) If she's been approved as skilled worker, then she needs to sit IELTS
5) Gather a first round of documents and employer applies for a Provincial Nomination.
6) Once approved, then can apply for PR.

If everything works out well, entire process to become landed immigrants should take 12-15 months.
Life is short, so let's get moving!

Many thanks for your kind reply Jrge,
I have some further question regarding the same matter

1. Does Furrier come under Skilled or Semi-skilled worker category , We searched online it came under the NOC code 6342?
2. As my Mrs. does not have any previous experience as furrier apart from the work she has done with her present employer (her employer is willing to give my Mrs. long term employment and Employer is satisfied with her work.) Does that matter?
3. What is the Minimum score needed in IELTS ?
4. When you say in clause ( 3). in your previous reply if we Go to American border and re-enter Canada then all this could be done straight away at the same time?

Many thanks for replying our questions and we heartily appreciate that.

1) I honestly don't know, but after reading the NOC, I would tent to believe is skilled. You wife's employer should phone HRDSC.
2) Whilst is tricky, the requirements for a person to fulfill the position are set by the employer, hence they could advertised the opening disclosing various of your wife's past skills, and conditions.
3) I think there's no minimum. But do not worry, English is my 4th language and I scored 9's on everything.
4) That's correct. That's why people say: I'm going to flagpole this weekend! It's all done right at port of entry. She only needs to pay $150.00 for her permit. And if she get gets a permit for a skilled worker, you could change yours at the same time.
Life is short, so let's get moving!
