Way forward after Visit Visa Rejection

Way forward after Visit Visa Rejection

I am an Indian National with ILR status working as a Hospital Doctor in the UK. I have previously sponsored family members for short visits to UK on family visit visa with no issues.

I recently sponsored my parents and brother (applying for the first time) for a short stay UK family visit visa. While my brother, who is an employee had no problems with being issued a UK visa, my parents were refused visa on the grounds of insufficient evidence of my fathers income/ employment.

My father is an employee working in the United Arab Emirates under a sponsor who owns the business and provides the license for a profit percentage every year. He is otherwise essentially responsible for managing the business including distrubuting and managing funds. In the application form he had rightly put down as being an employee and earning a regular estimated salary every month with an employment letter to confirm this.

Given the type of business he manages it was obviously difficult to show a steady payee type salary on his monthly statements and his bank statements generally showed larger sums being deposited every few months after each contract was completed. And to top that up he had also recently withdrawn a significant sum from the local national bonds scheme which he deposited in to his account and did not account for on visa application.

His visa was rejected on the basis that the funds/deposits in his account were far larger than claimed and were not accounted for during the application. And my mother was therefore refused a visa on the same basis. Although he has assets in India in the form of land/property, this was not disclosed given that the deeds were all in the local language needing translation and would add to all the hassle.

I would be grateful for some advice as to whether we need to proceed with appealing which I understand can take up to 3 months or so or to re-apply in the same category with further detailed documentation?

It's clear that that probably would have been granted visit visas if there had been a better explanation of the evidence and presentation of other evidence. You can work out how to do this for yourself if have time to read the guidance, or you could get a reputable professional to do all of this for you. If you have the money to do this I would suggest that is the best way forward. New applications will be quicker than appealing but you can do this at the same time as appealing if you wish.
