ILR - waitning time

Post by sasha » Fri Aug 06, 2004 3:51 pm

Can someone please help with the following query:

Is waiting time for ILR counted towards naturalisation ( Some people wait for months before they get ILR).
Or, is your waiting time included in your ILR. Is ILR stamp backdated to your previous visa expiry date!!

I hope this makes sense

thank you very much

Hi,

When you apply for ILR (or any FLR for that matter), your "then" immigration status is "frozen" and your application is processed.

When they finally decide to grant you the ILR, the new status is given with effect from the date of the decision, not from the date of your application.

So, going by the above, the time you spent while the ILR was getting processed, will not be counted towards that "12 months as an ILR holder" that is needed for applying for naturalisation.

regards.
