Help with a serious complicated issue about applying for uni

Post by chazzawazza » Wed May 25, 2016 12:13 am

Hi, my friend's in a very serious complicated situation. Ill try to explain very shortly.

Basically, they have applied for Indefinite leave to remain visa but got rejected and were given the right to appeal and have appealed. They have an unconditional offer from the university, however, cannot finalise the process as they cannot be a UK student since they don't have residency or citizenship, however, the uni have said that they cannot continue with the visa for international student without their papers which are still currently at the Home Office and because they're currently in the appeal.

When they appealed, their solicitor said that they would still be able to go to uni, however, this was last year. They have tried to get in contact with their solicitor recently(2 weeks) to see what they have to say about it now that it's nearer the time, although the solicitor has not replied. If there's anyone who can help with the situation (hopefully you can sort of understand what's happened), that would be great. And they have already taken a gap year because of this, they do not want another gap year.
Thanks

Friend needs ILR, and also to have been ordinarily resident in UK for 3 years, (by first day of academic year), in order to be classed as a home student.

Where is friend now?
How long a resident in UK?
Immigration status?
When was appeal lodged?
Reason for refusal of ILR?
All that is gold does not glitter; Not all those who wander are lost. E&OE.

1. My friend is living with their family in the UK, they're all working, however my friend has had to do a cash on hand job as they do not have any papers which are required for a 'proper' job, but their sibling and parents are all working normally with normal jobs.
2. Mother (independent) has been in the UK for 10 years. The rest have been here for 8 I think
3. I don't really know
4. They have a trial for the appeal in late September, however, their solicitor has made the mum apply for the thing where you have stayed 10 years in UK, I forgot, and the solicitor said that if that gets approved and it should since the mother has been here for 10 years then they don't need to go to the trial appeal.
5. The reason was that the mother (independent) had a work permit and at some point in her 10 years, was unable to work for a few months and that's what made the refusal I think.

I'm pretty close to my friend so they told me some things, I may not know everything but this is what I know so far.
If you can help in anyway, as in a solution to them going to university this September, that would be great
Many thanks.

1) & 3) 'Working cash in hand with no papers for a proper job' suggests some sort of irregular immigration status and is a concern;
this may cause complications (even if mother gets ILR).

4) Waiting for a September appeal is cutting it very, very fine.

Immigration status needs to be resolved and student needs to present evidence of valid status on day one of the academic year (which will be sometime in September for this year's cohort).

No less than ILR will do for Home fees basis.
Note the fee basis cannot normally be changed after a course commences.

Suggest friend puts in place a Plan B in case of delays and/or further refusal.

How about applying for an international student? Is that possible given the conditions, they said that they were willing to pay for all the expenses knowing that the prices are very high compared to the home students
