Biometric Residence Permit

Post by mbh1 » Mon Nov 12, 2018 4:32 pm

Hi I've tried filling in the Biometric Residence Permit application form, but my passport has expired and the online form won't let me enter an expiry date that is not in the future.

How do I apply for a BRP, when my passport with my ILR visa is expired?

Thanks

You will likely need to renew your passport first.

THanks for the reply, however the guidance on the .gov website clearly states that 'You can use this form to get a biometric residence permit (BRP) if you are in the UK and if:-•your UK visa is in a passport that is lost, stolen, damaged, or expired'. In this case the passport which contains the ILR visa is expired, so falls within this criterion.

It seems absurd that I am instructed to use this form to obtain a BRP if the passport which contains my visa is expired, but the same form cannot be completed, because the passport is expired!

The Home Office guide lines seem common sense to me and it not absurd. You still need a valid travel document.

You can still use the IRL visa in your old passport, you'll just need to travel with your expired and your new passport together.

If your want to transfer your visa from your expired passport to a new passport, or replace it with a BRP card, then you will still need a new valid passport to do it. They are not asking you for information from the expired passport. The new valid passport information is what you enter on the form.

Why would the Home Office issue you a BRP card, a visa, without a valid passport. They have never issued visa's without a current travel document, how are you meant to make use of it.
