I applied for ILR long stay on the 24th of April 2018 but had to change apartments soon after. I had not received my bio metrics by this time. Before moving I changed my address using the visa address update website (I do not have a copy of this email as this was done using a work email).
I did not hear from HO for the next 1 year until recently when I made an enquiry on the exceptions email chasing my bio metrics for any response. Home office then sent me a letter on my new address which i provided in the exceptions email refusing visa & stating over stay as they have kept sending me correspondence to the previous address & not heard back from myself.
The letter sent to me by HO is dated the 27th of feb 2019 & still has my old address however has just been posted to my new address.
My questions is 2 fold :
I have been told by my solicitor that I can use Service access request to retrieve information form the HO if I have changed the address? does any one have previous experience of using SAR in a similar case & how has that worked out for them?
My solicitor thinks we have a foot to stand on if we take it to Judicial Review as all correspondence from the Home Office has been sent to my previous address & signed for by whoever has moved in there. Does any one have previous experience of going to JR for a similar case.
Any help or advice would be very much appreciated.
