BRP REPLACEMENT VISA - OZ CITIZEN - NEED HELP

Hi all and thanks for this great forum!

I have a Tier 1 Exceptional Talent Visa. I'm currently back working in Australia and haven't been back to the UK since July 2018. I lost my BRP card in July, and reported it to the police, but later realised I hadn't reported it to the Home Office. I did so in November.

I have not applied for a BRP replacement single-entry visa, as I was under the impression I had only a month to get my BRP after getting the replacement visa, and I wasn't planning on moving back to the UK till the end of this year. I now realise this may not be correct.

I am now required to fly to the UK in 2.5 weeks for an urgent 2 week trip to have some important meetings (no working though).

Can I either:

- Enter as a non-visa national, on a tourist visa, and if so - would this affect my Tier 1 Visa (IT'S VERY IMPORTANT THAT IT DOESN'T)

- Get a replacement BRP visa with the 5 business day priority service, enter the UK with it, but not get a replacement BRP because I won't be able to stay long enough to apply and wait to receive it (1-3 months).

NOTE - if I get the replacement BRP visa, will I need to send my passport with the application? (I am currently waiting for my new Passport to be processed so won't receive it for another week, which would mean even with the 5 day priority service my visa processing time is very tight! Flying on 4 July.

If you are no longer working in the UK in your chosen field that you were endorsed for and still need to be endorsed for the duration of your visa, how sure are you that your visa was not curtailed or cancelled and/or endorsement withdrawn??

Hi,

Why would it be withdrawn? Is there any reason you would think this?

It's just the BRP card I have lost...

I am surely free to travel back and forth as I wish to so that I can work in both my home country and the UK - it's an arts based Talent Visa.

My visa is ends on May 2021...

I haven't received any notice that it has been withdrawn. How would I find this out?

The requirement for Tier 1 ET visa is to work in the UK and be endorsed for the whole time you are employed. If endorsement is withdrawn, your visa will be curtailed/cancelled. If you are out of the UK, this is often instant and often you won't be notified. With a substantial continuous absence of almost a year from the UK, it is possible.

The Home Office may curtail your Tier 1 (Exceptional Talent) leave to enter or remain if the
Designated Competent Body that endorsed the application which led to your current grant of leave
withdraws its endorsement of you.
