Leave the country during process of waiting fo renewed BPR when old BRP not yet expired

Post by Everlw » Fri Nov 22, 2019 1:54 pm

Hi I submitted my daughters application for BRP renew back in September but still haven’t received any news. We have her passport and old BRP back after checking the documents at visa Centre. We’ve booked flights for Christmas trip and her old BRP is not expired until February next year. Can anyone let me know if we can travel at all ?

I’ve seen a few threads about traveling with an expired BRP but in our case the old one is not yet expired when we travel back from holiday. Is it in theory okay ? Anyone has had similar experience at all ?

The key things I wanted to know are 1) if the old BRP became invalid when we applied for renewal thus risk not being enter the country when we are back even if on the card it is not expired; 2) if we leave the country even just for a week holiday will it make our in progress application invalid thus we will have to apply again when we are back ?

I tried to search online any contact numbers I can ask the HO but the only one I’ve found would only give recorded voices I.e. did not allow me to ask any questions with a real staff ! If you can share with me a workable immigration number it will also be most helpful.

Thank you so much.

The BRP remains valid until a replacement is issued. The valid BRP allows your daughter to board the plane to the UK. You will arrive at the UK border and IO will check the system to see if there was a replacement issued in case the BRP is cancelled in the meantime. No problem whatsoever for entry
2) if we leave the country even just for a week holiday will it make our in progress application invalid thus we will have to apply again when we are back ?
BRP replacement is NOT an immigration application so it will not be withdrawn if you leave the UK

Hi Everlw,

I have the same situation here. I made my application for ILR (10 year route) on beginning of October 2019, and it is still in the application process. After my document check and biometric, end of October, I have got the passports and valid BRP (valid until June 2020) return to me. I have also asked the person did biometric for me, if I can travel abroad during this period of application...she said YES. However, same question here (1) if I leave the country just for few days to France, does it affect my current ILR application even though I have a valid BRP (tier 2) until 2020 June?

Everlw, have you decided to have your daughters travel abroad?

Question: Could I travel abroad (to France) for just few days during Christmas period, by using my current passport and current valid BRP (June 2020), when my ILR application is still under process with HO?

Thank you very much,
medrche

Your circumstances are completely different to the user who started this topic, who is only RENEWING a BRP card and NOT making an immigration application.

If you have an ILR application pending with HO, you cannot leave the UK as your application will be considered withdrawn and you will lose your fee.

Please do not tag onto topics that are not relevant to your circumstances.

Alright, thank you very much for the answer...
In this case, I know it is in very limited time frame, could I change the application to PREMIUM service from STANDARD service. Note that I have already paid the application (STANDARD) and the application is in process.

You cannot 'upgrade' to super priority service once you have already submitted and paid.
