Is ILR required for UK born child with a BRP

Post by sherly2443 » Fri Jan 31, 2020 12:45 pm

Hi,

Please could someone guide me if I need to apply ILR for my daughter who was born in UK.

We were here on tier-2 general visa which is expiring by end of March 2020 and we are applying the ILR for whole family. I have a bit of doubt if I need to apply an ILR for my daughter as well. As i have few people mention that I can directly apply for her citizenship right after my ILR. My daughter was born in UK in 2015. We got her the BRP in 2016 to travel to India. They issued her a BRP that is valid till the same date as Our Tier -2 visa.

So my doubt here is, can i skip her ILR and directly apply for the British citizenship immediately after we get our ILR. Also would that be enough if I submit the citizenship application for her before her BRP expiry or does the Citizenship process be completed before her BRP expiry?

Thanks in advance

A UK born child does NOT need ILR or a valid visa to apply for citizenship. They have an entitlement to register as British once either parent is granted ilr.
