Switching from 10 years route to 5 years

Post by Odafeibusa » Mon Jul 10, 2023 1:15 pm

Hi.

I was granted leave on exceptional basis outside immigration rule on 10 years route in 2015. I am about to do my 3rd extension before ILR if I switch to 5 year route as my son is now a British citizen will I lose the years already spent on 10 years route towards ILR or it can be added to years on 5 years route.

Any opinion from members here would be appreciated. Thank you.

If you switch to the 5 year route, you start fresh with a new 5 year period.

Although if you meet the requirements, 10 years long residence is also potentially possible.

CR001: So what you are saying is I can add the eight and half years I have spent already on 10 year route to one and half year on the 5 year route to qualify for 10 Long residence for ILR?

If you're qualifying for it (ie didn't have long absences, etc) - yes.
