Uk visit visa refused... need advice

Post by jaisunny » Thu Aug 01, 2024 8:09 pm

I need some advice for a refused 2 week visit visa to the UK for my filipina patner in philippines.

They appear to have refused it based on...

1. Unknown transactions on the bank statements
2. Spending more than stated in March and May.

The above was explained in the cover letter that they appear to have overlooked.

Ie.. she receives a basic salary + commission every month. The commission is paid into another bank account (because the main account dont accept cheques) so she then transfers that amount to her main account, and this, i believe, is what they refer to as unknown payments. She also receives a small amount per month from her brothers living in USA as they have high paid jobs and like to help out as a gift. How does one prove the latter? I assume for the former, she should just provide bank statements from her other bank when reapplying?

The second point of refusal is the fact shes stated she spends X amount per month on bills. But they've seen that in May i visited her in philippines and she took car of hotels, food, adventures during my 2 week visit (all documents were provided). In May she went to hong kong to travel to disney land with her son while on school holidays to treat him, so it was a one off higher spending than usual in these 2 months. Again, all proof was submitted to prove she went to HK, bank statements show transactions on card machines in HK. What more evidence can one provide? or should she just state the average expenses in the last 6 months? if so, its dramatically higher than the last 10 years because of the March and May one-off holidays.

Here the issue, we need to meet on 15th Sept, she hasn't received her passport back yet. Which means if we reapply ASAP how can she attend biometrics again without the passport? if we wait for the passport to get delivered back to her home, how long does this take? need to get the ball rolling as i have a lot planned for her visit on 15th.

I attach original refusal letter.

Hope someone can help.

Adding to the second point, Its making me realise they want us to lie on the application. "Living expenses" was stated at 15000 per month but they claim in May 570000 was spent. This wasn't living expenses but a holiday. Do they want us to lie on the application? i thought telling the truth was paramount.

The commission is paid into another bank account (because the main account dont accept cheques) Why did she not leave the money in that account and just print out the statement to explain further income? so she then transfers that amount to her main account complicating things, these guys don't have time for forensics, and this, i believe, is what they refer to as unknown payments. She also receives a small amount per month from her brothers living in USA as they have high paid jobs and like to help out as a gift Money from unexplained sources. How does one prove the latter Western union receipts, money app transfer receipts, letter from brother stating he sends X amount monthly for help with family upkeep? I assume for the former, she should just provide bank statements from her other bank when reapplying?

But they've seen that in May i visited her in philippines No one looks at your travel plans, you're not the applicant and she took car of hotels, food, adventures during my 2 week visit To be truthful, she overshot her monthly income. You shouldn't be doing that when you know you're about to make an application.(all documents were provided). In May she went to hong kong to travel to disney land with her son while on school holidays to treat him Did she explain all these in her application? These are things that eats into her finances. 6-7 months before you make an application, you should be disciplined. unfortunately, she doesn't make that excess for it to be overlooked., so it was a one off higher spending than usual in these 2 months. Again, all proof was submitted to prove she went to HK, bank statements show transactions on card machines in HK. What more evidence can one provide a lot of money in the bank account, not less.? or should she just state the average expenses in the last 6 months? if so, its dramatically higher than the last 10 years They don't care about the 10 years, they care about the 6 monthsbecause of the March and May one-off holidays.

From your attached, she earns 265.45 monthly. That would be £1592.7 for 6 months. She states she spends almost £200 per month on living cost. In May she's spent £764.90.
Hence, £200 x 5 = 1,000 + 764.90 = £1764.90 (approx.)

In 6 months, she's spent more than she's earned, by a months wage.

She has a savings of £1,600, now she plans to go to the UK and spend £464.54 (over 2ce her monthly) for a 2 weeks holiday. Meaning when she comes back, she'll have to spend and extra £100 (half of the remaining month) on living cost.

The maths isn't looking good I'm afraid.

Hi,

Mays spending of £764 is not living costs. It is a holiday to disney land and funds used were from savings not from salary.

On visa application it states "living costs" it does not state holiday costs.

On visa refusal letter it states "living costs" and refers to the holiday cost.

Hi,

Mays spending of £764 is not living costs Hmmmm. It is a holiday to disney land and funds used were from savings not from salary. You've lost me. Ain't it salary that metamorphosized into savings?

On visa application it states "living costs" it does not state holiday costs. Intresting analysis. Not sure that would help the situation though.

On visa refusal letter it states "living costs" and refers to the holiday cost. Not sure you should be holding on to that word.
