eVisa Status

Post by Sylphid » Sat Oct 05, 2024 4:12 pm

My wife is non-EU. She previously obtained a BRP showing her ‘indefinite leave to remain’ status, and has now set up a UKVI account, that shows her status as ‘Settled’.
Looking into whether there was anything else we needed to do before 31/12/24, we noted that EU citizens also obtain ‘Settled’ status under the EU settlement scheme..and yet there are differences? For example, settled status is lost should those settled under the EU scheme leave the UK for more than five years, whereas in her case it was for more than two years.
Three questions:
1. Is there anything further my wife needs to do before 31/12/24?
2. How can Border Agency distinguish between people here under different rules, if the UKVI are using the blanket term ‘Settled’ on eVisas?
3. Should she worry about the change in terminology between ‘Indefinite leave to remain’ in the BRP, and ‘Settled’ in the eVisa?

I suppose UKVi would know that.

Is there really a change of terminology?

Indefinite leave to remain is how you settle in the UK. It’s also called ‘settlement’.

To add to the above advice given:
EU Settled Status is already an online status which is linked to EU citizens'/family members' passports.
