This is on behalf of a good friend who is a foreign student and finds herself in the following situation and I would greatly appreciate any help. I'll do my best to summarise all the detail.
She is a non eu resident but doesn't require a visa (just the gnib card).
Has been living here 5 years.
Attends college full time and works 20 hrs per week.
She has a son who is in primary school here and consequently gnib are (virtually) refusing to renew her card on the grounds that her son's education is being paid for by the state.
My understanding under international law is that each child 'has' to be educated regardless of the parents circumstances.. also she pays taxes. According to the citizens information site a dependent is fine so long as the parent is able to support the child? Obviously gnib are seeing it very differently.
Can anyone shed any further light on this?
