EU 1 Help

Hi,

Myself (an Irish citizen) and my girlfriend/partner (an Australian citizen) are currently living in the UK but are wanting to move back to Ireland, where we lived together for the year in 2007.

My girlfriend was allowed to work last year as she was on a working holiday visa but this expired in December 2007 and we moved to the UK.

I have been looking at our options, to see how my girlfriend could legally work again in Ireland and was told by a member of the Consular Division for the DFA to look into the residency side of things as my girlfriend does not qualify for a work permit or green card.

So my question is about the EU 1 form. Can I, as an Irish citizen sponsor my girlfriend to live and work in Ireland or do I need to be a non Irish other EU citizen? And does the fact that we both reside in the UK at present change anything.

Have you been working/self-employed for the time you have been in the UK?

yes we both currently work full-time.

bluefield, you can apply for a 5 years Resideny in DOJ through EU1 form for your gf (I do not know if you are registered as civil partner or not) but you can get an Irish Visa for your gf and then when you are here bring her with you to GNIB with all the valid documents that you were living and working together in the uk that may help. I think you have the civil partnership option open

You might want to double check with another source like the Immigrant Council of Ireland, but I think if you guys are unmarried partners, the only option would be the EU1 route, which you can do as you have been exercising an economic treaty right (working) in the UK. It's known as the Surinder Singh rule. Have you been living together for 2 years and can you provide proof?

If not, you could look at marrying in the UK. Once married, you could either apply for the residence card via EU1, or for a stamp 4 on the basis of being married to an Irish citizen.
