EU Fam card in Ireland, Moved to UK

Post by Mooncat » Thu Aug 13, 2020 6:49 pm

Hi there

I have a question: I’m a UK citizen, my wife is non EU, was able to bring her and settle in Ireland in 2017 and she received her 5 year EU fam card 6 months after landing .. However she was granted UK ILR in in late 2019 (exceptional circumstances) and we moved to UK!

My question is: does her residence in UK count towards her residency in Ireland on EU Fam card? Meaning will she be able to apply for Permanent residency in Ireland in 2023 even though she’s living in UK since 2019?

Thank you for your answers in advance 🙂

No. If she moved to the UK with you, she is not a resident in Ireland anymore as it's a different jurisdiction. I'd strongly advise you not to try claiming that she was a resident in Ireland if she is not living here. Two countries exchange extensive amount of information between each other and the truth will be revealed sooner or later.

Thank you so much, and certainly wasn’t our intention to deceive, we just wanted to make sure whether living in UK count as living in Ireland

Why would living in the UK count as living in Ireland? Would have thought it fairly obvious that as they are different countries, it would not
