EEA Family Permit for parents in law

Hi everyone,

I am a British national, eligible for Irish passport. My non EEA citizen wife and I were looking into moving to Ireland. As far as I am aware I can just pack up and go whilst my wife would need to apply for EEA family permit. However, is there a chance her parents can come and stay long term with us in Ireland through exercising treaty rights? We regularly support them financially. If yes, how does Brexit impact treaty rights? Do we have to make a move before the transition period ends?

First of all, how are you eligible for Irish passport? Are you currently an Irish citizen? (i.e. can you apply for an Irish passport right away, or do you need to apply for a document such as Foreign Birth Register first to be recognised as an Irish citizen?) This may have some implication as to whether you can exercise EU Treaty.

Secondly, just to clarify, EEA Family Permit is a visa issued by the UK government. Your intention is to live in Ireland, so a visa from the UK government is of no help to you at all.

Thirdly, for your wife, it depends on whether she is from a visa-required country. If she normally needs a visa to visit Ireland, she will need to apply for a Type C Join Family visa. Otherwise, she can simply come to Ireland right away. When she enters Ireland, just mention to the border control that she wants to join her husband who is a UK national. Once she is in Ireland, she can apply for EU1.

Fourthly, the same applies to your wife's parents, who are also recognised under EU1.

Lastly, yes Brexit will impact you. You will need to move before the transition period ends. UK and Ireland have a Common Travel Area which will likely still allow family reunification for UK nationals after Brexit. However, the whole CTA thing has never been written in legislation, so we don't yet know how they will work.

As I am a spouse of British and visa require national but as I hold a resident card issued in another EU/EEA ( which UK still in EU and card shown title " family members of EU/EEA citizens ") countries so no need visa to enter to Ireland ,your wife maybe need to answer the immigration at port of entry (if they ask ) what is her reason to coming here ( for my experienced the questions was so simple .. holiday or intended to settle here) , and that allow your wife to stay up to 3 months from the date of entry, once you settle then apply EU/EEA family residence card ...as permitted family members is very hard to get one as its shown on this board plus case of my friend also... I guess she fed up with it now after load of paperworks and proof and denial now she is on appeal which is taking nearly a year now but get nowhere near answer.
