Hi Guys,
Here is a question, would appreciate if you could comment.
One of my colleague in work had divorce last week. She is Non EU and he is EU.
the marriage lasted 4 years 8 months and she is in stamp 4 EUFam, since last 4 years. Her extension is due next year.
what is the law in this case ?. could she retain her stamp 4 or because she is divorced now, the DOJ can refuse her extension.?
They got married in Poland and divorced in Poland.
She informed GNIB on the same day when divorce was done with out the help of solicitor.
Your replies would be appreciated.

Seeing as she was married for over 3 years, she qualifies for retention of entitlements in her own right.

She can apply for permanent residence in her own right but needs to satisfy a few requirements.

She will need documents to prove her spouse was exercising treaty rights (working, self-employed or studying with health insurance) during the time they were married and also proof they were living together. For the time after that making up the 5 years, she will need documents to prove SHE was exercising treaty rights.
