Registering non Eu spouse

Post by maceamonn » Fri Mar 09, 2012 9:56 am

HI

I am irish and my wife is non EU and we visit ireland every year.

I am wondering if i can get a GNIB card for my wife when we visit and build up our years reckonable residence.

We will likely come back abroad but if we renewed every year we could make 3 years residency to get passport ?

would we have to arrive in ireland on a long term visa to register or could we do it on a tourist visa.

we have a son also who is entitled to irish citizenship.

You should read >>the difference between passport and citizenship<<. I assume your son is already an Irish citizen who is entitled to an Irish passport, which he doesn´t have yet? If so, you should get this sorted ASAP!

To answer the rest of your question we´d have to know where you live now.

Your case will be dealt with by Irish national law. Someone else will have to help you with that.

One thing that would make things easier for you is, if you move to any other EU-country (and subsequently to Ireland), as then this would be dealt with by EU law.

I think we are entitled to the residency but i am just wondering if we are not there most of the time will they discount our reckonable ..it is someone with experience of irish system and it appears they do not monitor if you leave the country etc.

Hi,

I couldn't delete my previous post so I meant nevermind.

Isn't your wife's passport stamped on arrival in the IRE and also when she returns back to her home country. How would you be able to show you have been a continous resident in IRE in such a case? Do you have any documents to support your claims of being resident in Ireland? I am sure few months absesnse per year is allowed when you are applying for the PR or citizenship but with the stamps on the passports its all black n White

I don't think there is any passport stamping leaving ireland currently as i remember it ...so from some previous comments they may just use the GNIB card which i assume is a seperate document, but i am not sure.

There is allowances for absences.

I meant her country of origin would put an immigration stamp on her passport when she leaves and enters the country. I am not sure if they do it in Africa but I think it is a common practice.
