Visa Rejected . Should i go for appeal ?

Visa Rejected . Should i go for appeal ?

My tier 1 entrepreneur visa got refused after long wait of 11 months. I swiched from psw and we were two members of entrepreneur team and third party funds were held abroad

They mentioned the following reasons of refusal

1) Bank letter from pakistan did not mentioned the names of entrepreneur teams and bank letter of one team member also not mentioned that bank is being regulated by FSA

2)my buisness company name is there in advertisements and buisness contracts but only one team member has his name in ads/buisness contracts

3) Bank documents are not original which were original except my other team member who sent copy of his degree but has original with him as well

Do i have any chance of win if i go for appeal.. I have 5 months left to complete my ten years in uk as well..i am confuse..i will be grateful for your guidance thanks

Hi,
If you go for appeal , first of all UKBA will give to hearing date after 4 5 months. Secondly , your case is not that strong to appeal initially you will get rejection after hearing too.
If your PSW is still valid for another 5 months then,
According to my opinion if you are completing 10 years in UK LEGALLY then you should go for ILR option. Thats the best way.

Thank you for your reply and advice

My psw leave is already expired and i heard that if appeal get rejected then waiting time dont count towards 10 years even when techincally our stay still legal in country

Some peope said that if you live more than 9 years you can still apply on humanitarian grounds..not sure again

Hi,

As per my knowledge if you appeal then it will take you around 4-5 months to get hearing date at which point your 10 years will get completed. I think the time you'll spend in waiting for appeal date and appeal itself will count towards your 10 years legal stay.

I would say just say that go for appeal but consult a lawyer as well avid clear this point to be on a safer side.

Hi,
You need good reputed immigration lawyer to fight. You might be eligible to get ILR.
