ENTERPRENUER 50K Route

Hi
ALL i am new to the forum. I am currently on PSW visa & wana apply for enterprenuer visa.

I have 3 years of subway experience as Manager hence i purchased a subway & have started trading since 8/5/2013.

My plan is to supply trained staff to SUBWAYS around my region. I would use my subway as training centre & coz its a SUBWAY i also have to trade as a normal subway or else cannot have the training environment as per subway Store.

I have purchsed the subway for £44k have sell contract as a proof.(MONEY INVESTED)
I have registered my company in DEC 2012.
I have one more partner he is also on PSW.with same years of exp as manager. He is gonna work as trainne manager & i would work as financial manager. Both statisfy NCQ level.
I have started trading have all the bills & invoices on companies name & have approx 10K in my personal account. Have 2 staff.

CAN I APPLY FOR ENTERPRENUER VISA ON ABOVE SITUATION.

hi

Subway(food franchise) itself isnt a graduate( level nvq4) business however ur roles as trainee manager & finance manager satisfy graduate level occupation. tricky bit will be how u people satisfy the case worker that subway u bought is a training center not just a food franchise like any other on market.

consider writing up a strong covering letter which will show that ur subway is different than other subways on market (ur one is a training center and core duties is to train staff and this staff training is ur main source of revenue not just selling food in subway)???

may a case worker in first instance consider the ur subway like other subways and will not consider it as an investment.???

wait for some others more expert advice.......

Both the job titles that you have mentioned are NQF Level 4 and above, so thats fine.

However the business itself is not at level 4 and above.

I understand your plan is to supply trained staff however you have invested £44k in a subway business and that is nowhere relevant to supplying staff.

You are saying that the core services of your business is to supply trained staff and at the end of the day you are selling sandwiches?? Does it make any sense?

If a person like me can catch you in a second, dont you think UKBA can come up with the same reason?

Correct me if I am wrong. UKBA guidelines suggests the job position should qualify nvq 4 or above not business. I have read policy many times no where it mentions about business being nvq level 4 it only states job position.


He must be engaged in business activity equivalent to at least NVQ Level 4 as stated in the Codes of Practice under the Tier 2 General visa.

please read latest policy guidelines.

ppl who applied b4 13dec2012 were not required to show a business of nvqf level4. however all new applicant under 50k cat must prove their business is at or above graduate level.

Totally Agree with entrepreneur9 ............... strongly recommend you to read policy guidance in details and there is a typical example of taxi firm is there .... just replace a word taxi with subway and rest is same ..... basically your job titles are nqf 4 but level of level is not nqf 4 and your business core services is to sell sandwiches rather than providing training to staff.

The reason why I am asking is I know some one who sold it recently and her wife was on T1E.
So I might be able to have a quick chat for you with that lady.

Below mention stuff are directly copied from ukba guidance. It says no where business in NQF level it only tells job position level.

Evidence of graduate level occupation
118. You should use this for your initial application under section d (see the attributes table for
initial applicants).
119. You must show that you have been working in an occupation which appears on the list of occupations skilled to National Qualifications Framework level 4 or above, as stated in the Codes of Practice on our website. “Working” in this context means that the core service your business provides to its customers or clients involves the business delivering a service in an occupation at this level. It excludes any work involved in administration, marketing or website functions for the business.
120. You must provide the Standard Occupational Classification (SOC) code of the occupation that you are working in, and confirm that this appears on the list of occupations skilled to National Qualifications Framework level 4 or above, as stated in the Codes of Practice.
More information on selecting this occupation is given on our website at www.ukba.homeoffice. gov.uk/business-sponsors/points/sponsoringmigrants/employingmigrants/codesofpractice/
. To find the relevant code of practice for your occupation, you must first identify the SOC code that most closely matches your work (other than the work that you do to administer
your business). You must also check that this SOC code is listed in the Codes of Practice as being skilled to at least NQF level 4. The SOC codes are published by the Office for National Statistics. Please do not ask us to match a job title or a job description to a SOC code for you, you must make this decision based on your own duties and responsibilities.
121. You must confirm your business activity and that you are trading.
Business activity
You must provide one or more documents from the following list to confirm your business activity:
• Advertising or marketing material that has been published locally or nationally, showing your name (and the name of the business if applicable) together with the business activity. This can include printouts of internet advertising;
• Article(s) in a newspaper or other publication showing your name (and the name of the business if applicable) together with the business activity. This can include an online link to the publication;
• Information from a trade fair(s) that you have had a stand or given a presentation to market your business. This must show your name (and the name of the business if applicable) together with the business activity;
• Personal registration with a trade’s body linked to your occupation.
AND
Trading activity
You must also provide one or more contracts showing trading. We will accept original documents or copies, but if it is a copy you must sign each page of the contract. The contract must show:
• Your name and the name of the business;
• the service provided by your business; and
• the name of the other party/parties involved in the contract and their contact details. These must include their full address including postal code, landline phone number and any email address

Hi again. After doing some research found that I was wrong.

Now my question is.

SUPPLYING TRAINED STAFF TO SUBWAY would it qualify As graduate job.
I have access to £50k in uk. After investing £44k in purchasing subway. My whole point of buying subway was to Hve access to proper enviourment for proper training.

@ a_mahla
if u are insisting to use ur subway as a training centre then u must be able to convince the case worker that its not an ordinary subway though a training centre and core source of revenue will be from staff trainging not by selling food. so think of a strong covering letter and mention ur subway as training centre.

if u cant write up a strong covering letter then think of something else or go for 200k.
