Our Hearing Experience.

Post by AceVenture » Fri Nov 15, 2013 4:41 pm

For all those out there who have a appeal scheduled... Hope this helps.

Me and my team member reached Hatton cross court this morning just to discover that our case was on float... means our judge was not turning up. So all his cases will be divided to other judges. Discussed the case with my barrister. A long wait.

We were called @ 2:00 p.m.

Main reasons 1) No Contact no. on Contract 2) Copy of CAR provided 3) Details of services on COntract not provided.

1) All of us me, my team partner and my wife entered the hearing room together.

2) The Judge seemed good and explained us the procedure.

3) The HO Barrister was an Indian . He asked to question us individually in separate rooms but the Judge refused it and allowed us together.

4) The HO barrister asked us silly questions - like what was our background in INdia, did we have a home n family back home .

5) None of the refusal reasons were discussed by HO Barrister.

6) He also asked us why dont you do your business ( Software n Business Consultancy) in India .

The Judge was listening to all arguments and noted it down .

Our Barrister argued with the Flexibility Policy and was discussing the points on refusal letter.

THe HO Barrister argued that we should return home as we have family and better prospect in India.

Finally the judge said he will decide and inform us with next 2 weeks.

Hope it helps all who are looking forward for their appeal.

Any speculations for the results are most welcomed .

Thanks.

Wish you best of all AceVenture. I am so shocked by such **** questions by HO barrister, I have been in the UK for last 7 years and my hearing is in December, if I am asked the same question, I dont know how will I control myself as this will make me mad!

@ AceVenture, as HO representative fail to make any submission on your refusal reasons but instead focus on asking silly questions, then I think the judge is very likely to give judgement in your favour.

I wish you the best of luck.

Just remembered ... He also asked us when was the last time we visited our family back home and now when we are here how do we contact are family. LOL ... Only he knows what way all this is connected to my case !!!

And all this went on for a good 20 - 25 mins.

I believe they questioned us in turns as the judge wanted that. Once the HO Barrister finished my Barrister took over, but she focussed on the refusal reasons and why my appeal should be granted.

Thanks.

Hi

you should have ask H.O Barrister that why you did,nt practice in India, do u have home & famliy in india.

How he knows what is good and what is bad for you, who is he to decide your future.

Asked him come to the refusal point and give his argument if he has any.

Good Luck
