Did some one notice on p99 of changes to immigration law

Hello every body,
I have just been through the policy guidance for the case worker and got stuck with the following statement.

" The applicant has spent a continuous period of five years lawfully in the UK, of which the most recent period must have been spent with leave as a Tier1 (Entrepreneur) migrant"

Could any one be kind enough to explain this to me.... Please read it 1st then comment and by the way it is for ILR from entrepreneur route.
