Visa extension for Child and MN1 Registration

Asking for a friend.

The parents are currently on Tier 1 (E). Current visa epiry date is 30 April 2016.

Child born in the UK - Aug 2015.

Goes abroad with mother in Dec 2015.

Applies for a PBS dependent visa (out of country) in Jan 2016. Granted till 30 April 2016 (as per leave of parents).

Parents are applying for extension of visa application in April for Tier 1 (E).

Father will be eligible for ILR in Dec 2016 based on LR.

He wants to know if he can skip applying for child and go to MN1 registration directly as he was born in the UK. Normally it will make sense and i know people whose child is born in uk and they dont apply for pbs dependent.
However, in this case, the child has had a pbs dependent leave, and if the child application is not made, will it make him an over stayer and have an impact on MN1 registration.

Any comments from senior members is highly appreciated.

No need to include UK-born child in the ILR application if the child doesn't intend to travel outside the UK before MN1 registration (and subsequently a British passport) is granted.

Thanks for your reply.. however just to re-confirm, the child will be in uk with an expired leave for 6 months before parents become eligible for ilr.

The child does not require valid leave if BC registration will be done. UK born child is entitled to register as BC.
