Hi,

I am asking this question on my friend behalf. He has sponsorship offer from a company in UK. He is on Entrepreneur visa right now with team and about to expiring.
My question is it possible that he doesn't go for extension his TIER 1 entrepreneur visa and instead apply for as sponsorship visa.

I would be really gratful your response.

According to my knowledge, yes he can switch to any other catergory before his current visa expires. Thanks

Yes you can switch to Tier 2 General from Tier 1E

Sorry I would like to extend my question bit further. Given the recent situation with entrepreneur if God-forbid my extension application's been refused can I apply fresh application based on Tier 2 Sponsorship?
and what about my 3c (ten years route) would that be still intact or broken after applying fresh application?

Yes, you can apply for Tier 2 after any potential rejection. But you will not have any 3C protection once you apply for T2

Your lawful residence remain untouched if after a refusal your T2 application is eventually successful

There is no such thing as 3C coming back - it can''t.
If the later application is successful, you have still been an overstayer from the final rejection of the last visa until the approval of the new visa.
The only thing is that HO will ignore that overstay period for all future applications such as ILR.
So, still an overstayer but it has no negative impact.
PS: not sure why people do this (you are not the only one) - you started your question as though it was for your friend. All later questions use "my". You don't have to pretend it is for someone else.
