More than 12 months or Less

Dear All,

Please guide me with the below mentioned Visa details and stay in the UK.

I would like to apply for a 'TIER 1 POST STUDY WORK DEPENDENT' visa for my Spouse who is in my home country and she never travelled to UK or applied for EC before. UKBA guidance notes clearly states that after JUNE 9th 2012 the above mentioned Dependent category needs maintenance funds of £600 for 90 days if the main applicant has been in the UK for more than 12 months else Dependents of Tier 1 applicants who have been in the UK for less than 12 months should maintain £1800 for 90 days.

UKBA did not mention anything specific about the 12 months of stay for the main applicant with regards to the category i.e. TIER 4 or TIER 1 POST STUDY WORK.

9th FEB 2010 - Tier 4 STUDENT (ENTRY TO UK WITH VALIDITY UPTO 30TH NOV 2011)

16TH NOV 2011- MASTERS DEGREE AWARDED

19TH NOV 2011- APPLIED FOR TIER 1 POST STUDY WORK VISA

19TH DEC 2011- TIER 1 POST STUDY WORK VISA GRANTED (VALID UPTO 19 DEC 2013)

11TH JAN 2012- TRAVELLED TO HOME COUNTRY

8TH APRIL 2012- GOT MARRIED

26TH JUNE 2012- CAME BACK TO UK

Almost 5 and 1/2 months I have not been in the UK


Please guide me whether I (Main Applicant) fall into the category of 'more than 12 months' or 'Less than 12 months' so that I can clear all my confusion.

you can apply for your spouse as your dependant but there are many technical part in application process. it is better if you take legal advice and sought some services.
its better to do things right at 1st attempt rather getting refused and go for appeal and other things. some people said MR Marfat give some free advices. you can contact him or others before you make application for your spouse.

Mr Marfat cannot be an answer to every solution. It is very evident from your post that you are promoting him to every forum member. If you have to give suggestion to the OP about getting legal advice any solicitor should be able to do the job. Mr Marfat is a barrister (that too not fully qualified by his own admission) and it is very unusual for people to contact barristers for advice.

I can appreciate that he seems like an alright guy when i spoke to him but that doesn't mean you promote him to everyone in this forum. I can agree that he has some specialist skill with regards to ACCA cases but defies logic to say he has the solution for every immigration problems.

Forum members are there to share their experience with one another and seek advice if someone who may have already undergone a similar situation.

Blindly promoting a particular person for solicitation is wrong. Mr Marfat may offer free initial consultation but his eventual objective surely is to charge his clients and make money
