Flr fp extension tax credits

Hi everyone I'm new to this site so not sure if I should start a new topic

I'm about to do wife's extension for flr fp 10 yr route I have read from other posts that it is ok to claim Cb wtc and ctc
the problem I have is my wife is the main claiment for ctc it comes under her name even tho it's joint it shows her name
For wtc I am the main claiment it comes under my name

Another problem I have is when my wife filled the ctc form she didn't tick the box to tell them she's under immigration control

Will this be a problem?

Has she breached her conditions?

My wife visa expires 6 Aug 2017 we will be using premium centre cauz she needs to go to her brothers wedding

I don't think it will boost our chances but I am very worried about my wife not ticking that box on tax form

I have been to few solicitors for advice one of them said to pay back the money which we don't have right now she can be banned for ten years. Then we will say we are not claiming child tax
Another solicitor said it shouldn't matter
Third solicitor said we don't have enough time we need apply for extension before here visa expires

I have been worried sick been having sleepless nights, my family could be split because of a silly mistake my wife made I should checked the tax forms before I send them

Has anyone been refused using this same day service? and what are the most likely reasons of refusal

Has anyone breached there conditions of stay? will I be able to get appeal

Booked an appointment at premium centre for thurs 3rd Aug
I know no one has replied to my post
I will still tell u all the outcome of my wife application

I don't think you have any reason to worry she is allowed to claim ctc as long as it is in joint names.
Just declare on the form what ever you are claiming accordingly.
Also worst scenario if there is any problem she won't just get banned or deported immediately like you thinking

If your husband nationality is UK/EU and he is the main claimant on the benefit form you will be fine and if it is you the wife making that claim and your first leave to remain permit doesn't says you can have access to benefits then there will be problem in waiting if the HO finds out. Meaning you breach the condition of your leave to stay in UK and as well as deception for lying on the form.

I am preparing myself for when it happens not sure if I will get an appeal all I can do is hope
