Child element of Universal credit

Post by Seyed2024 » Sat Nov 22, 2025 4:48 pm

I am British citizen and I have son who is 13 years old. He has been on child dependent visa for the past 3 years. His 2.5 years visa extended recently and his IRL will be due in May 2027. He goes to school and doing good in his studies. On his BRP, it says no recourse to public funds which means he is isn't eligible for child benefit and any other benefits. I am struggling financially, despite I work full time. I hope you understand the current financial situation. I applied for Universal Credit on my own name and rights. My wife also does not receive any benefits as she is not eligible. My son and wife will complete 5 years route in two years and will apply for ILR. I am on Universal Credit and also work full time to support my family financially. I fulfill all financial requirements, like maintenance, visa fee and ihs.

I have one question, on my Universal credit claim, I receive child element of £333.33 each month as I have a child living with me. I provided all my documents to DWP. Dwp didn't approve my child benefit but pay me child element of Universal Credit since last year. I asked several solicitors and they don't have any understanding about this if it will have any effect on my child visa, if I receive child element of Universal credit. I don't want to effect my child current or future stay in any way.

To add , my my child do not receive child benefit of 26 pound a week or any other benefits. The only thing I receive is child element. I receive child element as I have one child, my son living with me. Is it ok for me to receive child element from DWP?

Many thanks. Looking forward to your reply Kind regards
