Hi ,

I am looking for advice as how to proceed.

I have been working for a company for last 3 years and i had taken Loss Of Pay(break) for 3 months from Aug/2011 to Dec/2011.
Now i had applied for Tier 2(intra-Company Transfer)
- Enclosed all required documents
- Enclosed LOA(Leave of Absence) letter from Company stating that i had availed level from Aug/2011 to Dec/2011.

- I got a Refusal of Enter Clarence with following ECO Comment:
under COS points claimed is 30 and Points award as 0.
ECO Comment:

You have not provided salary slips dating 12 months prior to your application. As per the immigration Rules. Futhermore the letter you have provided from your employer stating that you were granted annual leave from Aug/2011 to Dec/2011, does not state if you were granted paid or unpaid leave.

- If i get one more letter from my employer stating its unpaid leave and so there are no pay slips. Will this help me to get my visa thru ?

- Do i need to go for admin review for this ? or an appeal would help the purpose.

- My overseas team suggesting to go for new application (if approved) Are we sure we would get visa if we re-apply with clear letter from Employer ?>

Pls suggest how to proceed.

Go for new application, provide letter from your company stating that you have been granted unpaid leave, ( UKBA/British Embassy wants to check/verify whether you have quit the job and joined again) hence they are asking for documents that you are on payroll of your company but without pay for 5 months.

Also Provide remaining months salary slips, without fail. including recent August month salary slip.
