Tier 2 Certificate of sponsorship HELP

Post by amit.verhani » Tue Oct 30, 2012 4:13 pm

Hello all,

I am currently on Tier 1 (Post Study Work) visa and have been with my employer for past 1 year 6 months. My employer is happy to sponsor me under Tier 2 General.

We have got the Sponsor license all fine.
Can some please answer the following questions :

1. Since I am in the UK - I will need an "unrestricted" CoS - does my employer need to request for allocation of unrestricted CoS ?

2. When filling the CoS - What should be my "Tier and Category" ?
a. General
b. General ( changes to employment )
c. Tier 4 Switching to Tier 2

Any help is greatly appreciated.
thanks a lot.

only if he doesn't have one available. Should that be the case your sponsor would need to request an increase in the CoS allocation. This is done online through the SMS.
2
Tier 2 General. It is the employer's responsibility, not yours, to assign the CoS and he should know that.

thanks for the prompt reply manci,
the thing is, its a small company and I am very much involved in the CoS assignment process.

also, the options we have on the sub category drop down are:
1. General (switching immigration category)
2. General (Extensions)
3. General (changes of employment)
4. General (New hires £150,000 and over)
5. General (Tier 4 graduate switching to tier 2)

I am guessing option 1 is right for my situation ??

thanks once again,
just to tell you the BIG MESS UP - before getting me involved with the CoS process, my company had already assigned me a CoS but under the category (Tier 4 switching to Tier 2)

Now they withdrew that CoS, have requested for more allocation as they have used everything.

So basicallly, I am only gonna wait till we get more allocation, which is fine as my current VISA runs out only on 3 Feb 2013.

THANKS A MILLION MANCI, cant tell you how relieved I am now.
I am a web developer based in London, and If I can be of any help to you please just let me know. I really wish to thank you from the bottom of my heart.

You are a legend!!

Hi again, I have some further doubts - i have been in touch with a solicitor and he's got me even more confused than I already was - can you please help me understand this COS assignment process ?

1.
solicitor :: The job summary field on COS should show what job is the closest match to your role in the company
Me :: I am employed as a Front End Developer - but the closest match I could find in SOC was "Computer Programmer" - what should I write in Job summary / details section on the COS ?

2. Does the migrant need to leave and re-enter the UK during the period of approval ?
Solicitor :: you should answer ‘yes’ to this - even if you have no plans to travel outside UK.
me :: why would I do that ? is that correct ?

3. Allowances – 0.01,
Solicitor :: is this correct?
Me :: In the SMS, this field was marked as Mandatory and my employer wasn't able to enter 0 as the form wouldn't validate. so he was told by a staff from UKBA to enter it as 0.01 - Any suggestions on this?
Solicitor :: You are able to leave this blank.

Please ADVICE,
Thanks a lot

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

Telephone advice is also available from the UKBA helpline: 0300 123 4699

Hi Manci,

Last question, what supporting evidence am I supposed to send with the application for Tier 2 General via please ?

This is what I have got so far, am I missing anything ?
1. Passport with BRP
2. Two Photographs
3. Degree certificate (as proof of English language)
4. My employer has checked the box for Maintenance funds so no bank statements needed, right ?

Should I send any of the following please ?
1. Contract of employment ?
2. Last years P60 form ?
3. Pay Slips ?

waiting for your expert advice,
Thanks a lot for everything.
