Cooling off period - Tier 2 ICT to Tier 2 Gneral

Hi,

I just came to know about this cooling off period.I have returned back from UK (Tier 2 ICT) on 1st of September,2012.My Visa was valid upto 5th jan, 2013.So, as per Cooling off period for Tier 2, if i have to re-apply for Tier 2 general VISA, then i have to wait until Sep,2013 or else Jan,2014?

Do I need to inform my sponsor to withdraw my cos application? As I can't lodge my application before the completion of cooling off period.

Someone please confirm.
