Tier 2 General Visa

Hello

This is my first post here :). So, first of all, thanks to everyone who has contributed in providing the information on this forum. Its really helpful.

I'm in the midst of a Tier 2 General application being made by my employer. I have some queries regarding the documentation required to be submitted.

Updates so far (I'm applying from Outside UK):

1. Employer is an A-rated sponsor for Tier 2 ICT and Tier 2 General category. I'm a business analyst and consultant and have been working with the employer for last 3 and a half years.
2. Remuneration was agreed at XX,000 GBP Basic, before tax. Allowances have not been mentioned yet but may be over and above the basic salary. I have double checked and the salary offered is much higher than the requirement as per Tier 2 G list.
3. It will be 40 hours per week (I have double-checked the salary vis-a-vis work hours and it is mugh higher than the required minimum for my role)
4. I was not eligible to apply for ICT because I work for the subsidiary of the parent company, which is a different entity than the UK subsidiary.
5. Thus, RLMT was conducted and completed.
6. Application (assuming that's what its called) has been submitted for allocation of a CoS number
7. I'm now awaiting a decision from UKBA for allocating/approving the same. Therefore, by the virtue of hope, I have started accumulating the information and documents that I may need if and when I apply for my entry clearance.

My questions (so far :)) are as follows:

1. English language requirement - I have appeared for IELTS and am due to receive my result in a week from today. I'm fairly confident of clearing this above B1 level (as required per the Tier 2 G norms). My question is, do I still need to provide my university degree when I apply for entry clearance?

2. Funds - I have sufficient funds for self + spouse (GBP 1500+) from the last 12 months in my bank account. My question is, should I also provide a stand-alone bank statement of my spouse's account as well (this bank account also has the minimum thresh-hold of 600 GBP or more for last 6) months). Will it by helpful/of any use?

3. Spouse - We have been married for little over 3 years. However, call it the lack of effort, but we haven't been able to get a marriage certificate yet. Our passports do have the respective spouse's name on them. We also have an original wedding invite, wedding pictures and receipts from various vendors re: expenditure during the wedding. Would you still recommend that I get a marriage certificate made by the court of law? Kindly suggest.

4. Visa - I have spent time in the UK in 2005-06 on a student visa. I did apply for an extension which was refused as my attendance was too less during the last 3 months. I therefore decided not to appeal and returned to my home country within the specified timelines. I was issued a business visitor visa in 2013 and have visited UK twice since then for business meetings. Do you think this will have an impact on my Tier 2 G application? I have checked with the attorney and he doesnt seem to think so since my last refusal was more than 5 years ago, and I have been issued a visa since then. Of course I know its just an informed opinion and the final decision rests with the UKBA.

1. If you have got your original university degree, no harm in including it.
2. Can include as additional support document.
3. If you haven't got a marriage certificate, why not simply get an affidavit done from an authorized notary. Doesn't cost much and it doesnt take much time to get it done. He should have the proper format for it.
4. Should not impact. But again it is at the discretion of UKBA.

Thought I should update everyone on the documents submitted (eventually) as it might be helpful for others

1. Valid CoS - Allocation document from SMS (Maintenance certified for self + spouse by A-rated sponsor) - 30 points

2. Salary - Mentioned on CoS as XX,000 GBP per annum - 20 points

3. English Language - IELTS result (Original) - 10 Points

4. Maintenance funds - Certified by A-rated sponsor as endorsed on CoS (I did not submit any salary slips or personal bank account statements) - 10 Points

Documents submitted:

1. Valid CoS (I took a print-out of the electronic version)
2. Current + Previous passports (Self + Spouse)
3. Original Marriage Certificate
4. IOM Certificate showing no Tuberculosis (Original certificate for self + spouse)
5. IELTS Test Report Format (Showing an overall score of 8.0 - Minimum requirement is 4.0)
6. Covering letter - Specifying my current role in New Delhi, Why I have been chosen to move to UK, the list of documents submitted with the application, a quick account of my travel history & visas including currently held UK business visa, circumstances for previous refusal, and why the application does not fall under general grounds for refusal). Cover letter was enclosed as the first document in the application pack.
7. Letter of support (To provide details regarding a previous refusal, circumstances, and therefore disclosing all information. Please note - My attorney's advice (And I agree with him 100%) is to not withhold any facts, provide detailed information regarding any refusals (even for non-UK visas) and disclose full immigration history. This ensures you are not using any deception to mask any previous information (UKBA will have it anyway, so its important to give full & honest account of past immigration issues, if any). My previous UK visa refusal was based on an erstwhile student visa extension (this refusal decision was from more than 6 years ago)
8. All applicable visa forms including dependent visa forms
9. Self-assessment for points-based calculator
10. Supplementary documents - Original birth certificates (self + spouse), Wedding pictures

Visa was issued on 21/06/2013 for self + spouse

UKBA traditionally doesnt accept an affidavit from the notary. My attorney recommended to get a marriage certificate made from the applicable local marriage registrar (Took an entire day, much inclusive of typical functioning of an indian governmental enterprise, searing heat of 45 degree celsius with no air-conditioning and some serious money but in the end, I did get the original certificate on the same day)
