Hope someone will be able to help out with this:
Current situation
Previous leave - tier 1 psw
Expired 7th august 2014
I had applied for tier 2 visa on June 2014 from within the uk
(company sponsored)
My visa application has been refused (got a letter
On 22nd august)
Reason for refusal:
Salary
My employer had put down a salary of £22000
For a 45 hour work week. However for my soc code 3545
The minimum salary is £22000 for 40 hour work week
Which means that for 40 hours, my salary is going to be
£19555.56
I have spoken to my employer who are happy to
Give me a pay raise or reduce the hours to 40 per week
Instead of 45
Given that the decision of refusal is correct, I believe an appeal is not going to be any good
I would like to reapply, however I have a few questions:
A) I searched for the specific provision relating to 28 days grace period. Couldn't find it in the ukba documentation.
There's news articles and comments on forums confirming that
But it'd be good to know a provision / official statement
As I plan to include it in my cover letter for the reapplication
B) the 28 day period; does it start from the expiry if my leave or from when I have received notice of the refusal?
I understand I can't work during that time
C) regarding overstaying : does this make me an overstayer even though my initial (in time) application was with ukba after the expiry of my psw leave to remain?
D) is it correct that if my fresh application is refused for any reasons , I will not be allowed to appeal?
E) if D happens, will I Not be able to re-enter for a year?
I can't get anything done till tomorrow because of bank holidays and stuff but if any of you guys could help me out with a few pointers, that'll be excellent .
