Salary change timing (answer will be appreciated)

Post by Javedsheikh » Thu Jun 02, 2016 5:46 pm

Hi Every One,

When I got my visa in 2014.
I have few questions regarding recent Tier 2 changes. I am currently on Tier 2 Visa and my salary as per certificate of sponsorship is £20300.

I have following queries.

The new minimum salary is £20800 for new entrant which is also going to be increased to £25000 in autumn this year. Will it affect me already on Tier 2 Visa?

I was under 25 years old and also inexperience but now I am an experienced worker and over 25 years old and my extension is due next year. Does my company needs to change the salary NOW because I am over 25 or any change in the salary will be applied as per the rules when my extension is due next year or right now?

Kind Regards

Only have to meet the salary requirement at the time the COS is issued for your extension.

I have another question related to salaries. According to this page the minimum salary for experienced workers is to go up to £25000 in autumn this year, but according to the SOC list (appendix J), there are different salary requirements for different jobs and the minimum threshold for my job (2112) is £27200 for experienced workers. So which document are we to believe? They're both issued on the gov website!

The higher of the two salaries would apply. In your case £27200.

Thank you gag285. Also, would the new salary have to come into effect at the time of my application or on the CoS start date?

You need to apply for extension with this salary. You will only receive the requisite 20 points for salary if your CoS clearly mentions you are being paid the appropriate salary for your role in the codes of practise. Be very careful with this.

Hi Javed,

I am in a same situation as you.

I work under the SOC code 2112. I am on my tier 2 first three year and will need an extension in may 2017.

Salary wise there is two sections in the guidance some are band system and the other one is new entrant and experienced.

If we say £27200 is what we have to earn. I have read in the guidance the salary mentioned is for 39 hours. I only work 37 hours a week can the salary prorated for 37hours ?????

Please give me your ideas.

Thanks
