Hi,
My question is rather specific and I couldn't find any other post which addressed it specifically.
Situation: I am under a Tier 2 General visa (sponsored by my current job). I was made redundant and my last day will be 23rd of September 2016. I have already found a new job with another employment and we have started the visa proceedings.
The Problem: The new job has scheduled a priority appointment on the 13th of September, despite me telling them I had to travel abroad on the 15th of September. Because it is a priority appointment I was told I can get my passport back on the next day, but the Biometric Residence Permit (BRP) will take at least 7 days to be sent to me.
My questions:
1- I have travel plans on the 15th. Is there some document that can be issued stating my visa is being processed already, allowing me to travel and return to the country 5 days later ?
2- I am Brazilian and have permission to enter the UK as a tourist without visa requirements. If I left the country without a visa, I could come back and enter as a tourist, but would that have any consequences for my Indefinite Leave to Remain application in the end of next year - e.g. for the ILR I have to be 5 years on a tier 2, but if I enter as a tourist for a few days would that reset the clock ?
3- Alternatively I could just ask the new job to rebook the appointment for october. The potential issue is that I have another trip abroad right after my last day of work on the 23rd of september. If by then I have not switched my visa to the new company, can I still travel and re-enter the country under my current tier 2 ? Remembering my current employer will notify the UK border on the day of my last employment, so I was wondering if already on that date I would not be allowed in the country under that visa.
