ILR Application with more than 60 days gap in employment

Hello

I changed employers in 2014. My new employer did a RMLT and issued a new CoS to me. The gap between the end of my old job and the start of my new leave to remain was 58 days. However I only started the new job a few days after the leave to remain was issued, so the gap between the end of my old job and start of my new job was 64 days.

I understand there cannot be a gap in employment of more than 60 days. My question is: which gap will the Home Office consider (58 days or 64 days)? Will I be able to apply for ILR? Is there any formal guidance about this, as I haven't been able to find anything in their guidance documents.

The gap in 245AAA( b ) is between the date of unemployment and the subsequent date of application for leave.
