Tier 2 Work Sponcership Info

Hi,

I have few query as listed below:

1. If a person living in India applies for a Job in UK and clear the interview process, what type of VISA is issued ?

2. If a person living in India receives UK Tier 2 work sponcership from UK employer, then what are the next steps person has to take ?

Can I get some info on above query.

1. There is only one work sponsored visa and that is Tier 2 General if being sponsored by a UK employer.

2. Sponsor has to complete RLMT to prove no settled/British or EU citizen is suitable for the job. Only after this RLMT process can 'you' be offered the job and the sponsor request and issue a CoS. You then have to apply for the visa and pay the visa fee and immigration health surcharge. Submit and then wait for decision. Once visa is granted, you can travel from date of visa issue.

It can take a few days, a couple of weeks or a few weeks. Depends on the supporting evidence and your sponsors RLMT process etc. Sponsor must be on the HO approved list and have a sponsor licence.

You also have to get a salary of at least £30,000pa.

You also can only work for your sponsor. You cannot contract or work through an umbrella/ltd company. If you want to change sponsors, you have to apply for a new visa.

1. Is 30000 GBP a new threshold salary ? Is it compulsory salary provided by all the sponcers to individuals or this value changes ?

2. If requested, will the UK sponcer willing to pay VISA charges and Immigration health surcharge ?

1. £30,000pa is the mandatory minimum salary. It changed earlier this year. Then within different SOC's, there are also salary thresholds that must be met.

2. Request from who??? Most sponsors DO NOT pay the visa fee and Immigration Health Surcharge. You have to pay it.

2. You need more than just a letter. Sponsors do not usually pay the visa fees and IHS charge. The applicant pays that. Sponsors already have to pay the Immigration Skills Charge plus other associated sponsor costs.

3. I think if I receive A-rated sponcer license, then it's not mandatory to show the English score. Can I get more info on this.

4. After receiving work sponcership letter, is it good to apply for visa independently or through some visa consultant companies ? Can you advice me on this ?

3. Unless you are from an English speaking country on the list of exempt countries, you need to prove your English.

4. Most do it on their own. Your choice if you choose to use an advisor BUT members are not permitted to post company names or advisor details on the forum.

NHS yes, maternity yes. Any other employer/salary package related benefits you have to ask your employer. State benefits such as child benefits, child tax credits, housing benefits etc definitely not as your visa will be stamped stating NO RECOURSE TO PUBLIC FUNDS.

You have to pay your own airfare and your own accommodation. Why do you think you get everything paid for you??

A word of advice as you seem to have no idea how this all works even though I have provided the link that you should have looked at in the first instance, if your sponsor is charging you for a) the CoS and b) 'commission' or a monthly 'fee' to sponsor you, they are NOT a genuine sponsor.

The sponsor provides you with a COS, a job and pays you a salary. Everything else YOU must pay for, i.e. living expenses etc.

If they are a genuine sponsor, you need to agree your terms of employment with them and any allowances they have available. This is NOT an immigration question however you must be aware that not all allowances are permitted to 'bump' your salary to the required minimum level.

CR001 has already provided you the detailed answer.
I will add the following.

-£30,000 applies to experienced workers and not new entrants. The minimum salary for new entrants is £20,800 (or the salary for SOC Code whichever is HIGHER)

- English language as CR001 has stated is exempted if you belong from a majority English speaking country OR you have graduated from UK University in a course which was taught in English.

- Sponsor will do the following,
* Provide you COS letter
* Carry out RMLT
* Pay immigration skills surcharge (ISC). This is £1000 per year normally (has some exceptions) and will be paid at at once (for example, for 3 years it will be £3000).

- You will do the following
* Fill Tier2 application form. Enter COS number. Job title, sponsor details, salary details, RMLT details provided by sponsor.
* Pay IHS fee, This is £200 per year (For example, for 3 years it will be £600)
* Pay application fee.
(Though unlikely some generous sponsors can reimburse you for IHS and application fees)

Most important things are that RMLT is properly done, sponsor is genuine and salary is correct (check salary in light of number of hours)
