Tier 2 visa application with previous Tier 4 scholarship

Hi guys,

I have been studying in the UK under a government scholarship until June 2019. I left the country shortly thereafter to start working back home. However, recently I have received a job offer from an employer in the UK who'll be sponsoring my Tier 2, and my Tier 4 visa has well expired. I understand that a consent/release letter from my scholarship sponsor will be required if I were to switch from a T4 to a T2, but in my circumstances I obviously will be applying for a T2 from outside the UK.

Do I still require that consent letter in this case? Cheers.

I don't think you need the consent letter anymore.

However, do you need to pay back your govt employer if you resign now or did you sign any bond to serve them for certain duration when you received that scholarship?
My advice is based on personal research/experience, so pls check relevant UKVI sources.

I'm supposed to serve in the civil service for some years and I've applied; However some recent issues have led to a hiring freeze in the govt and thus I'm working in the private sector for now.
I then applied for and have been offered a grad scheme in London which I intend to take, but wanted to check if I'd still need a consent letter in the situation mentioned above, as I'd be applying for a T2 visa when I've received a scholarship during my T4 which was fewer than 12 months prior.

I think you can find the answer to your question in the conditions of your scholarship.

Usually these government funded scholarships require scholars to come back to their countries once the programme has ended, and stay there for a specified amount of time.

For example, if you are/were a recipient of a Chevening scholarship you must return to your country for at least 2 years, and that's non negotiable, there is no chance of getting a consent letter or anything like that to be able to work in the UK. In such case, you will be asked to pay back all the monies they gave you during your programme.

If you even insist to go further without informing your entity, the Home Office will know you are breaking the conditions of your scholarship and they'll deny your visa anyway, and you'll be definitely putting in risk any future entry. That happened to a friend a year ago.

Cheers, that's helpful. If I recall correctly, the scholarship documentation I supplemented during my T4 application does not specify that bond at all. Nonetheless, to be safe, I'll advise HR to start the T2 application 12 months after my academic course (and hence my scholarship) ended. Do you reckon that would be acceptable to HO then?

If the conditions of your scholarship say that you have to stay in your country for one year after you finish your programme, or doesn't have any condition like that, you can try applying 12 months after you finished, should not be any problem.

I also would suggest informing to HR very well about your condition.
