Child born in UK to Tier 2 ICT Long Term Visa Parents

Post by shobhitsri » Wed Jan 01, 2020 2:11 pm

Hi there,
I am in UK since 2015 on Tier 2 ICT long term Visa. My kid was born on December, 2015. We got Indian passport for him.
I was just thinking that we are here from a long period and my kid is now 4 years old and will be 4 and half till Visa expires. So, Is there any chance we can apply ILR/ British citizenship for him and then for us?
I understand there must be some certain rules for that so please can you help me in that?
Thanks in advance.

No. He cannot apply for ilr, there is no such route simply being born here 4 years ago. The citizenship rule states that he can apply to register as British once either parent is granted ilr. Your visa doesn't qualify for ilr based on 5 years residence. He needs 10 years residence otherwise to qualify to register as British on Form T, provided he meets the requirements. There is mobile or citizenship option simply because a child is British. It would be a FLR fp parent visa route.

He also cannot apply once aged 5 based on being stateless, because he is not stateless as he has an Indian passport.
