I'm coming up to the extension point in my tier 2 general visa, having previously reached the cap in my salary (which I believe I can't currently move above on my current first 3 year period because it was the maximum the role was advertised for as part of the RLMT as a restricted certificate - that's what I'm gathering from what HR told me and I can make out from the employer sponsorship guidance on 28.23 or 29.46 - https://assets.publishing.service.gov.u ... 0_v1.0.pdf).
I understand as part of the extension rules, the RLMT is waived which I believe means an unrestricted certificate of sponsorship can be used.
I guess the main thrust of the question is, outside of 'standard' increases in salary that are applied across all workers in the business (which don't need to be reported), does applying for the visa extension and getting it essentially remove the salary cap I'm currently on? That is my impression. I assume that if a salary increase happens, it doesn't have to happen at the time of the application for extension when the sponsor announces the salary to be paid on the unrestricted CoS - i.e. it can happen once the extension is approved or any time after, so long as the home office is notified on the sponsorship system of the pay increase (noting that any large increase is likely to bring suspicion - would a 10% increase bring suspicion?)
My company still wants me, but with the whole coronovirus thing going on, I suspect they will want to hold on any sort of pay increase until things get abit more certain, so I guess I'm just looking for reassurance or confirmation that the ability to get a pay rise beyond the RMLT cap is essentially opened up if a tier 2 extension is successfully granted - because I couldn't see anything explicit about it in the sponsor guidance...Hence this post. I presume it is possible based off what I can make out from other posts on this forum warning about large salary increases on tier 2, but I'm not sure if that was inside their advertised salary range for the RMLT.
