PBS dependant extension if the main applicant's ILR appliction in process

Post by Hayman » Fri Jun 26, 2020 10:39 am

Dear all,

I'd like to ask the question about PBS dependant extension if the main applicant's ILR application is in process.

I am qualified to apply for ILR under Tier 2 (general) route over 5 years working. Recently, I plan to start my ILR application after I have passed my Life in the UK test. My wife came to the UK having PBS dependant visa in July 2018, and her visa will be expired in 14-7-20. I initially wanted to apply ILR using priority service in May or June, however, due to COVID-19, UKVI priority service is suspended currently, and I have to use the standard service (up to 6 months for the decision). Can I ask if my wife is able to apply for the 3-year PBS extension even if my ILR application in process? What's the difference when filling on the online application form?

If it not applicable, does it mean that she has to extend her visa using my current Tier 2 visa, which is valid until 4-3-21? Because I had renewed my work permit visa this February due to change of employment, but my wife didn't update hers as we plan to renew her visa under my ILR previously. In such a way, we have to renew her visa twice in the coming 3 years to meet the 5 years residential requirement.

Much appreciated!

Yes.
What's the difference when filling on the online application form?
No difference. Simply put an expiry date of your visa/ILR in the IHS page as 3 years from date of application to get the correct IHS fee. Add a covering letter linking to your ILR. If your ILR fails, the dependent application will also fail.
If it not applicable, does it mean that she has to extend her visa using my current Tier 2 visa, which is valid until 4-3-21?
No.

Her residence clock for ILR starts counting from the date her visa was initially ISSUED, not the date she entered the UK.

Please do not post your tier 2 dependent queries in the Immigration for Family sub forum. Your topic was moved to the Tier 2 sub forum.

Hi, thank you so much for your reply :) . It's really helpful. Sorry for posting questions twice as there is a system error when I post for the first time. I apology for the inconvenience caused.
