Tier 5 GAE to skilled-worker (new points-based immigration system)

Post by Bob96 » Thu Sep 24, 2020 7:00 pm

I am currently working for my employer under a Tier 5 GAE internship. My employer is not a sponsor but I am now assisting them in the process of applying.

To apply under the new system, the company needs to apply as a tier 2 sponsor. In appendix A it states

'You must indicate which jobs are currently vacant and for which you intend to assign a CoS. If you have already identified someone that you wish to employ via the sponsorship system, you should provide evidence of how you identified this person. If you identified this person as a result of a recruitment process, you should include copies of advertisements placed to recruit for the job, details of any applicants and why they were not suitable for the job. You should confirm whether the person is already working for you.’

The issue here is that the role I originally applied for had a different title and slightly more responsibilities. My employer decided to go the Tier 5 GAE route, so the job description and title was adjusted to fit the supernumeracy criteria. Both the advertisement of the original job description from the Ad and the new job description will need to be provided as proof. I am now being offered a permanent position with slightly more responsibilities and the same title as role I initially applied for. Will this be an issue? Has anyone been in this position or has knowledge and could provide advice?

Thank you.
