max stay on tier 2 visa before applying ILR 5 year route

Post by kapilgarg81 » Sat Jan 02, 2021 4:21 pm

I am in UK on tier 2 visa for 1.5 years; since July 2019.and my current BRP expires on 9 July 2021.
Now I have got CoS for 5 years (Feb 2021 to Feb 2026) and have applied for Skilled worker visa chosing >3 years visa option in application.

My Question is;
1. What would be the total duration of visa that will be issued to me now? Would it be CoS end date - Feb 2026? Because If I get 5 year visa; then my total stay on tier2 will become 6.5 years;
Would it be against the rules which states that you can not be more than 6 years on tier 2 visa.

2. Would I be able to apply for ILR after 5 years; that is in July 2024 under 5 years route?

Thanks

1. Probably full duration as they get more fee/IHS out of you. Also, I believe there's no longer 6 years max rule (still seeing different opinions on this forum though). You'll probably know when you are on the payment page.

2. Yes, once your reach 5 years minus 28 days, you can apply for ILR.
My advice is based on personal research/experience, so pls check relevant UKVI sources.
