Hi,
Can you please help me out? I think my scenario is extremely rare.
I got my ILR (Tier 2 route) almost 18 months ago. My baby has british passport as she born in UK.
My wife and baby came to India in Jan 2020 for holiday and supposed to go back to UK in March but got stuck in India due to COVID-19 situation.
My wife is on Tier2 dependant visa which was expired in June 2020 (She is due for ILR in Jan 2021). We applied for ILR dependant as people told me that I cant apply for Tier2 dependant extension outside the country(and my Tier 2 visa also expired); and the visa has been granted for two and half years. I'm aware that her ILR clock for 5ys will be reset, but we had no option at that time as we want to come to the UK as my baby needs vaccination. We are currently still in India (due to personal reasons) and my wife's vignette expires in a week.
Few days ago I got an email from UKBA in response to one of my emails in May saying that UKBA has introduced CVCS(Coronavirus Visa Concession Scheme). In this scheme UKBA will will automatically extend the visa for the people, where leave expires while the holder is overseas and unable to return to the UK due to COVID-19.

My question to you will be..
1. Is it possible to cancel the current ILR dependant visa and request UKBA to extend old Tier2 dependant through this scheme so that my wife will be eligible for ILR straight away?
2.As my wife already got visa, is there a way we can get benefit from this?
3. If yes, would it be better to apply for this scheme from India or UK?
Please help.
Thanks,
Tim
