Newborn UK visa application type- Confused

Post by ramboottan21 » Sat Oct 09, 2021 12:56 pm

Dear Experts

I am on Tier 2 general visa. I arrived UK in 2017 November. My wife is right now tier2 dependant. We got a baby in 2020 August and he born in UK. We are from India. Right now he got Indian passport. But not having UK visa.

This post is to ask you, how to apply for his UK visa? I am confused, to apply as parent or apply as child.

What I did?
1. Visited https://www.gov.uk/browse/visas-immigration
2. Opted https://www.gov.uk/browse/visas-immigra ... mily-visas
3. Opted https://www.gov.uk/uk-family-visa
3.1 Here started the confusions.
Apply as parent or

Apply as child?

My Tier2 general visa validity is upto 2022. So I don't need to apply anything for myself/my wife.

My worry is, if I opt apply as child, some of the questions are not relevant.

There is no requirement for a non-travelling UK born child to apply for leave to remain.

However, there may be NHS considerations.

Child may apply as a skilled worker dependant child, if parents wish to do so.

Hi Vinny,

I didn't understand the answer.

Non travelling? - We wish to travel to India. So if he doesn't have UK visa, how he can pass immigration at airport when we travel?

Apply for leave to remain? - I didn't understand. Does it mean, as he born in UK, he don't need a UK visa as a tier2 general dependant?

We, entire family will apply for Permanent residence in 2022 November. Before that we wish to travel India once.

If travelling, then do apply.
