Soon-to-have Tier 2 visa, looking to get my girlfriend to come and live in the UK, not sure how to

Post by Prototype_ » Sat Dec 11, 2021 10:06 pm

Hi everyone,

First of all, thank you so much for this website, it helps and lot and it feels really good to have people to ask something to when it's really blurry on official websites or on the internet.

Here is my current situation: I am French and I am being recruited by a company able to sponsor me for a Tier 2 visa - which is really great. I would like to come and live in the UK with my girlfriend, however we do not know exactly what path to follow. We've been together for 4 years without any way to prove it - we've never lived together officially, so no shared bill whatsoever. We are willing to go into a French Civil partnership ( PACS ) or a British civil union if needed, but we're unsure if it'll help. On top of that, my girlfriend want to work in the UK, and I've read that certain types of Visa don't give the ability to work in the UK.

Can someone enlighten me about all of this ? If needed, please ask me anything and I'll answer as fast as possible !

Thank you a lot once again!

Your girlfriend will only be eligible for a Skilled Worker Dependant visa, which allows work in the UK, in one of two ways:
1
You are married or in a civil partnership (you'll need to check if PACS is recognised in the UK) or
2
You must have been living together in a relationship similar to marriage or civil partnership for at least the two years before the date of application (documentary evidence must be provided).

Alternatively, your girlfriend may seek a skilled worker sponsorship in her own right.

First of all, thank you for your answer !

So basically, if we engage in a recognised civil partnership in a week, and then ask for a visa in a couple month, there'll be no problem for her to have a Dependant visa, right ?

Correct if the civil partnership is recognised in the UK and all other visa requirements are met.

Then, according to this legislation, PACS being recognised as a civil partnership in the UK, we just have to officialise the PACS in France and then ask for a Dependant Visa in the UK and it should be accepted !

Thank you very much, Manci, it helps a lot !
