T2 Dependant Expires while Main applicant applies for IDLR

Post by richardk8 » Sun Oct 02, 2022 2:05 pm

Hi,

I was on a Tier 2 (general) from 2018 to 2022 (4 years) with my wife as a dependent. Earlier this year I changed sponsors with my current visa expiring July 2023. I got a new T2 Skilled worker visa but did not renew my wife's dependant. Despite the change in sponsor, from other threads on here my understanding is that her visa is still valid until expiry date.

I plan to apply for IDLR when I become eligible to apply in April 2023. My wife's dependent visa expires in 04 May 2023. Since the IDLR can take some time, potentially, I will not have it by the time her visa expires. What are my options? I don't want to extend her for 2 months just to wait for the IDLR decision and then extending again for 3 years. She is also not eligible for IDLR at the same time as me - her continuous residence has been reset, so it will be another 5 years.

Also to make things difficult for us is she is is currently not in the UK, but plans to return around June/July 2023.

I wanted to confirm that my wife's visa is still valid despite me changing sponsors. The pinned thread is old and some of the referenced gov.uk links have been "withdrawn"
