FLR HRO to Skilled Worker

Post by subbufoton » Fri May 16, 2025 9:25 pm

Hi

I have Submitted my FLR HRO application and booked for biometrics. Before giving my biometrics to FLR HRO I secured Skilled Worker COS and applied for the skilled worker visa. Unfortunately the both biometrics was booked on the same day. On the day of biometrics morning was skilled worker biometrics and evening was FLR HRO biometrics. Morning I gave my Skilled Worker Biometrics and later I contacted a solicitor and asked do I need to skip FLR HRO biometrics or do I need to submit it. Solicitor mentioned go to the Croydon service and support centre where the biometrics booked ask them. As he mentioned I went there explained the whole thing and asked for suggestion. They mentioned if i dont give biometrics my Section 3c will broke and it effects my skilled worker. As they mentioned I submitted the FLR HRO biometrics & submitted my passport too. Still I haven’t received my skilled worker decision it’s been 5 months and even I applied the priority service. Now I want to get my passport back even if the skilled worker is pending. Some people saying if you ask for passport FLR HRO will be withdrawn and effects skilled worker application. As I read Home office guidance once application is varied the previous application will be removed. But in my case I haven’t got any decision yet. Can I ask home office to return my passport back does it really effect my skilled worker application. Please suggest me.

What is the basis of your FLR(HRO) application?

You can't have two immigration applications with the Home Office at the same time. Typically the second one submitted would be treated as vary the first one. So which application did you submit later?

@lolo2

You applied for permission to stay as a Skilled Worker under Appendix Skilled Worker of the Immigration Rules. Your application has been refused because you do not meet SW 14A.1 (a), (b).

You application has been considered under SW 14A.1 which states:

The applicant must:
(a) genuinely intend, and be able, to undertake the role for which they are being sponsored; and

(b) not intend to undertake employment other than in the role for which they are being sponsored, or as otherwise permitted by SW 18.2.

I have considered the information you have provided in support of your application, and I am not satisfied that you are genuinely capable of working in the role you are being sponsored for because you do not possess an acceptable level of knowledge of the industry.

After initial assessment of your application, you were invited to attend an interview
