Hi All,
I would appreciate your guidance on this - checking this for a friend

He is currently under skilled worker visa eligible for ILR 5 year route next year, But he is keen on applying ILR 10 year route next month as he becomes eligible for it. Please can you help with the queries below

1. Can his wife and kids stay in the skilled worker dependent category until next year
2. Can they apply for ILR as skilled worker dependents when they become eligible next year even though he settled via the 10 year route

Please could you also help with gov.uk links where these are clearly defined?

Please can I check if this is a new change in policy. As when I was in the same situation in 2017 and my spouse was in a tier 2 dependent visa. She had to switch to a FLR (M) - ILR dependent for 5 years (2 applications of 2.5 years each) before applying for her ILR. This was due to me getting ILR via the 10 year route instead of the 5 year tier 2 route for settlement.

The rules changed just over a year ago for 10 year ILR applicants and their skilled worker dependents.

So what applied to your circumstances in 2017 is no longer relevant or applicable.
