Switching from SOC 6131 to new employer, is 3-month CoS rule required?

Post by doughng » Tue Mar 03, 2026 8:08 pm

Hello,

I am currently in the UK on a Health and Care Worker visa. My work history is:

-- 3 years under Care workers and home carers (SOC 6135)
-- 1 year under Nursing auxiliaries and assistants (SOC 6131)

All of this has been under Skilled Worker permission.

I am now planning to move to a new employer, and the new job will be under Health and Care Worker visa. I understand there is a rule requiring 3 months of employment before a Certificate of Sponsorship can be assigned in some cases.

Since I am already on continuous Skilled Worker permission, and I am moving from SOC 6131 with a new Health and Care Worker sponsor, does the 3 month employment requirement apply before the new employer can assign the CoS ?

Thank you for any clarification
