Kid ILR/citizenship on basis of father citizenship

Post by r17tanwer » Sun Oct 06, 2024 8:03 pm

Hi, I have a query around my kid ILR/Passport.

I already got my ILR in May 2024 (5 year PBS route) and next year in may month will apply for citizenship, my wife had multiple breaks in her stay so she is not eligible to apply for ILR until 2027. My Kid (born outside UK) who is just turned to 17 in last month and continue staying and studying in UK from April 2021.

My question here please -

1. When my kid can apply for his ILR/ citizenship? Is it possible my kid can apply after my citizenship as he will be less than 18 year old until that?
2. He have to apply for ILR or citizenship?
3. Is MN1 route application for him, plz suggest

Thanks

1. No he cannot apply for citizenship if he doesn't have ilr. He applies fornilr when your spouse does.

2. He needs ilr before he can apply for citizenship. He can apply for ilr when your spouse does, provided he is not outing an independent life.

3. No. He has no entitlement to register as British as he is born abroad. He needs ilr first before he can apply for citizenship. No shortcut route for him unfortunately.

What will be the possible routes please for my son to apply for his ILR, my spouse is not eligible for next two years for her ILR. Is there no way, my son can apply on behalf of his father (who is going to become citizen in next 6 month)

No, he doesn't qualify for ilr until your spouse does. The immigration rules are very clear on this regarding child dependents of skilled worker visa holders, they qualify when the depedent spouse does.

There is short cut route for him.
